Terms and Conditions
Welcome to Evo’s Drivers. By using our services, you agree to comply with and be bound by the following terms and conditions. These terms are separated into two sections: Driver Hire & Recruitment Services and Logistics Services.
Driver Hire & Recruitment Services
1. Services Provided
Evo’s Drivers provides qualified, professional drivers for temporary and permanent positions to businesses. We match drivers with clients based on experience, qualification, and compliance with UK driving regulations.
2. Candidate Placement
Evo’s Drivers provides staffing services and does not guarantee permanent employment or ongoing assignments.
All placements are subject to client approval and may be terminated or changed at their discretion.
Candidates must provide accurate and truthful information when registering with us.
3. Client Responsibilities
Clients agree to provide accurate job descriptions and expectations.
Evo’s Drivers is not liable for any issues arising from a client’s failure to provide correct information or comply with employment laws.
4. Payment & Refund Policy
Payment terms for clients will be detailed in the relevant contract or invoice.
No refunds will be issued unless otherwise stated in writing.
5. Substitution
If a candidate is unavailable or unsuitable, Evo’s Drivers reserves the right to provide a replacement of similar qualifications and experience where possible.
Insurance:
Evo’s Drivers does not provide insurance coverage for drivers once placed with a client. It is the client’s responsibility to ensure that all drivers engaged through our services are covered by appropriate insurance, including motor, liability, and employer’s liability where applicable. Evo’s Drivers shall not be liable for any claims, damages, or losses arising from the client’s failure to arrange sufficient coverage.
6. Professional Conduct
All workers representing Evo’s Drivers are expected to act professionally at all times. This includes being punctual, respectful to clients and colleagues and communicating promptly. Any form of misconduct, rudeness or failure to uphold these standards may result in removal from our active worker list.
7. Liability
Evo’s employees accepts no liability for any loss, damage or injury caused by a candidate’s actions once placed with a client. Clients are responsible for ensuring proper supervision and insurance for all employees engaged.
8. Termination
Either party may terminate services by providing notice as stipulated in the contract or agreement. Termination does not relieve any party of any obligations incurred prior to the termination.
9. Confidentiality
Both parties agree to keep all information received from the other party as confidential and to use such information solely for the purpose of this agreement. Confidential information includes, but is not limited to, business strategies, financial information, application details, and any other property information.
Logistics Services
1. Service Description
Evo’s Drivers offers logistics services including courier, haulage, warehouse staffing, general freight forwarding and logistics support.
2. Booking and Instructions
Clients are responsible for providing accurate and complete information regarding the nature of goods, delivery requirements, and any special handling instructions.
3. Insurance For Goods
We do not provide insurance cover for goods unless explicitly instructed in writing and confirmed by us. If insurance is arranged, it is subject to the terms of the insurer. Without such written instruction and confirmation, all goods are carried entirely at the owner’s risk. Evo’s Drivers accepts no lability for uninsured goods.
4. Dangerous and Restricted Goods
We do not accept dangerous, hazardous, or restricted goods without prior written agreement. If such goods are found or declared late, we reserve the right to refuse, return, or dispose of them at the customer’s expense. The customer shall indemnify Evo’s Drivers for any resulting loss or damage.
5. Lien and Sale of Goods
Evo’s Drivers has a general lien over all goods and related documents in its possession for any unpaid charges or liabilities owed by the customer. If payments are not made, Evo’s Drivers may, with prior written notice, sell or dispose of the goods and apply the proceeds to the outstanding debt. In the case of perishable goods, this right may be exercised immediately.
6. Failure to Collect or Take Delivery
If the recipient fails to take delivery of goods at the designated time and location, Evo’s Drivers may store the goods at the client’s risk and expense. After 60 days, we reserve the right to dispose of the goods, following reasonable notice to the customer.
7. Customer Responsibilities
Customers warrant that all goods are properly described, packed, labelled, and suitable for transport. The customer shall also ensure any containers or transport units provided are fit for purpose. Evo’s Drivers accepts no liability for loss or damage arising from incorrect or misleading information.
8. Claims
Any claim must be submitted in writing within 14 days of the event giving rise to the claim. No claim will be considered after nine months unless legal action has commenced and notice has been given to us in writing.
9. Force Majeure
Evo’s Drivers is not liable for any delay, loss, or damage caused by events beyond our reasonable control, including strikes, natural disasters, pandemics, or governmental restrictions.
10. Jurisdiction
These terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts. Evo’s Drivers reserves the right to require arbitration under the London Maritime Arbitrators Association (LMAA) rules in certain cases.
General
1. Use of the Website
You must be at least 18 years old to use this website.
You agree to use the website for lawful purposes only.
We reserve the right to modify, suspend or discontinue any part of the website at any time.
2. Intellectual Property
All content on this website, including logos, text, and images, is the property of Evo’s Drivers and may not be copied, reproduced, or redistributed without permission.
3. Employment Relationship
All staff supplied by Evo’s Drivers are employees of Evo’s Drivers. The relationship between Evo’s Drivers and its staff is that of employer and employee. Clients hiring drivers from Evo’s Drivers do so through a contract with Evo’s Drivers as the employer. The client has no direct employment relationship with the drivers and is responsible for supervising and managing drivers while they are working on their premises or assignment.
4. Liability
Evo’s Drivers accepts full responsibility as the employer for all employment-related matters concerning the staff, including compliance with employment law, payment of wages, taxes, and insurance. However, clients remain responsible for ensuring proper supervision, safety, and insurance during the period drivers are engaged on their premises.
5.Insurance
Evo’s Drivers have their own Public Liability & Employers Insurance.
5. Privacy
Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.
6. Amendments
Evo’s Drivers reserves the right to update these terms at any time. Clients will be notified of any significant changes.
